Calcutta High Court Remarks on Vande Mataram in Madrasas

The court pointed out that there are thousands of Christian educational institutions across the country where students, regardless of their religious background, participate in prayers addressed to God. It questioned whether students belonging to other faiths object to participating in such practices merely because they are associated with a particular religious tradition.

Justice Chakraborty further observed that asking someone to recite words outside the traditions of their own faith does not automatically mean that the person abandons or changes their religion. The court indicated that participation in certain cultural or national practices within educational institutions should not necessarily be interpreted as a matter of religious conversion or loss of religious identity.

The PIL challenges the decision requiring madrasas to sing six stanzas of Vande Mataram, arguing that the directive raises concerns related to religious freedom and constitutional rights. During the proceedings, the court heard arguments from both sides and discussed various constitutional aspects of the issue.

The High Court has not yet delivered its final verdict in the matter. The case remains under consideration, and further hearings are expected before a final decision is announced. Meanwhile, the court's observations have sparked fresh discussions on the balance between national traditions, educational practices, and religious freedom.
