Prayagraj: The Allahabad High Court has delivered an important ruling on the use of licensed firearms, stating that an arms licence is granted for lawful purposes and self-defence—not for celebratory firing during weddings, religious events, or other social functions.
The judgment was delivered by Justice Saurabh Shyam Shamshery, who dismissed a petition filed by Akhilesh Kumar challenging the cancellation of his firearm licence.
According to the case records, authorities found that out of 857 cartridges purchased by the licence holder, there was no satisfactory account for 757 cartridges. Due to the failure to maintain proper ammunition records, the district administration cancelled the licence.
Upholding the cancellation, the High Court observed that every firearm licence holder has a legal obligation to maintain complete records of ammunition purchased, used, and remaining in stock. Failure to account for ammunition amounts to a violation of licence conditions.
The Court further emphasized that an arms licence is a privilege, not an absolute right. Therefore, licence holders are expected to strictly comply with all statutory conditions attached to the licence.
The Bench made it clear that firing weapons to celebrate weddings, birthdays, religious functions, or similar occasions is not a permissible use of a licensed firearm. Such acts constitute a direct breach of the licence conditions and may invite legal consequences.
Incidents of celebratory firing have repeatedly resulted in accidental deaths and serious injuries across India. Courts and law enforcement agencies have consistently expressed concern over the misuse of licensed weapons during public celebrations.
The judgment also referred to the broader issue of irresponsible firearm use. In December 2025, a wedding ceremony in Noida witnessed an accidental discharge while a person was loading a pistol. Although no one was injured, the incident highlighted the dangers associated with careless handling of firearms.
Legal experts believe the ruling reinforces responsible firearm ownership and sends a strong message that licensed weapons must only be used within the limits prescribed by law. The decision is expected to influence future cases involving misuse of licensed firearms and inadequate ammunition records.
