The Supreme Court on Tuesday imposed 10 lakh cost on the Uttar Pradesh government over the prolonged preventive detention of an accused in the 2024 Sambhal violence case under the National Security Act (NSA).
The court observed that the state government had failed to provide a satisfactory justification for keeping the person in detention for nearly a year. The court directed that the 10 lakh amount be paid to the detained person.
The Supreme Court also emphasized that preventive detention laws must be used strictly according to established legal principles. The court made it clear that preventive detention cannot be used as a form of punishment for an alleged offence.
According to the court, the purpose of preventive detention is to prevent a potential threat to public order or security, rather than to punish a person for an alleged crime.
The court directed the authorities to follow established legal principles while exercising powers under preventive detention laws.
The order has come in connection with legal proceedings arising from the 2024 Sambhal violence. The case has once again highlighted the legal safeguards surrounding preventive detention and the need for authorities to provide proper justification when a person is detained for a prolonged period under the NSA.The Supreme Court imposed 10 lakh cost on the Uttar Pradesh government over the prolonged NSA detention of an accused in the 2024 Sambhal violence case.
